Last Updated: September 7, 2026
Welcome to Virtus Athlete. These Terms of Service (“Terms”) are an agreement between you and Virtus Athlete (“Virtus,” “we,” “us,” or “our”) and govern your and your athlete’s use of the Virtus Athlete website, mentorship services, group sessions, one-on-one mentorship sessions, digital content, and related services (collectively, the “Program”).
Please read these Terms carefully. By registering for, purchasing, accessing, or using the Program, you acknowledge that you have read, understood, and agreed to these Terms.
1. Eligibility and Parental Consent
The person registering an athlete for Virtus Athlete must be at least 18 years old and must be the athlete’s parent or legal guardian, or otherwise have legal authority to enroll the athlete.
By registering an athlete, you confirm that:
You are authorized to enter into these Terms on behalf of yourself and the athlete;
You consent to the athlete’s participation in the Program;
You accept responsibility for the athlete’s use of and participation in the Program; and
The athlete is at least 12 years old.
Parents and legal guardians are responsible for determining whether participation in Virtus Athlete is appropriate for their athlete.
2. The Virtus Athlete Program
Virtus Athlete is a virtual athlete mentorship and personal development program connecting young athletes with current collegiate, professional, and other experienced athletes and mentors.
Membership may include:
One 30-minute individual mentorship session each month with an available Virtus Athlete Mentor;
Bi-weekly live group development and mentorship sessions;
Access to recordings or replays of eligible group sessions;

Recruiting, preparation, communication, habits, and athlete-development education;

Opportunities such as complimentary tickets to watch a mentor compete when available and at Virtus Athlete’s discretion.
Specific mentors, guest speakers, session schedules, ticket availability, content, features, and benefits are subject to availability and are not guaranteed.
Virtus may add, modify, replace, or discontinue Program features from time to time. We will provide reasonable notice when a change materially affects a member’s ongoing participation.
3. Registration and Access
You agree to provide accurate and current information when registering for the Program.
Parents or guardians may receive links that allow them to schedule sessions or otherwise access portions of the Program. You are responsible for protecting those links and any login credentials associated with your membership.
Anyone with access to a scheduling or Program access link may potentially be able to use that link. You are responsible for ensuring that access information is shared only with authorized individuals.
You are responsible for activity associated with your registration, account, or access links. Please notify Virtus promptly if you believe someone has obtained unauthorized access.
4. Membership, Billing, and Payment
Recurring Membership
Virtus Athlete membership is currently $99.00 per month, unless a different price or promotional arrangement is presented to you at enrollment.
Membership is billed on a recurring basis.
Payment Processing
Payments are processed through Square or another payment processor designated by Virtus.
By enrolling in a recurring membership, you authorize Virtus, through its payment processor, to charge the payment method you provide for each applicable billing period until your membership is cancelled in accordance with Section 5.

Virtus may occasionally offer promotional pricing, free months, discounts, annual commitments, or other special offers. Additional conditions disclosed at the time of the promotion may apply.
Price Changes
Virtus may change membership pricing from time to time. We will provide advance notice of a price change before the new price applies to an existing membership.
Continued membership after the effective date of the new price constitutes acceptance of the updated price.
5. Cancellation and Refund Policy
30-Day Cancellation Notice
Memberships may be cancelled at any time by providing Virtus Athlete with at least 30 days’ notice.
Cancellation requests must be sent by email to:
virtusathletementorship@gmail.com
The 30-day cancellation period begins when Virtus receives the cancellation request.
Depending on the timing of your billing cycle, a scheduled payment may fall within the 30-day notice period and remain due.
No Refunds
All payments to Virtus Athlete are non-refundable.
Virtus does not provide refunds or credits for:
Partial months;
Missed one-on-one sessions;
Missed group sessions;
Failure to use available Program benefits;
Scheduling conflicts;
Changes in mentor availability; or
A member’s decision to stop participating before the end of a paid membership period.
Nothing in this section limits any refund or other right that cannot legally be waived under applicable law.
6. Nature of the Program and Important Disclaimers
Virtus Athlete provides mentorship, education, guidance, and personal-development support.
Virtus Athlete is not a medical, mental-health, athletic-training, academic-advising, recruiting, financial, or legal service.
Unless separately qualified and expressly engaged in that professional capacity, Virtus mentors are not acting as physicians, psychologists, therapists, counselors, certified athletic trainers, dietitians, attorneys, financial advisors, academic advisors, recruiting agents, or other licensed professionals through their participation in Virtus Athlete.
No Professional Advice
Information discussed through the Program is provided for general mentorship and educational purposes.
Nothing communicated through Virtus Athlete should be considered medical, psychological, mental-health, nutritional, legal, financial, recruiting, or other professional advice.
Parents and athletes should consult an appropriately qualified professional regarding matters requiring professional evaluation or advice.
No Guaranteed Outcomes
Virtus does not guarantee any particular result from participation in the Program.
This includes, without limitation, any guarantee of:
Improved athletic performance;
Increased playing time;
Making a particular team;
College recruitment;
Admission to a school or university;
Athletic scholarships;
NCAA or other athletic eligibility;
Professional contracts;
Improved mental or physical performance; or
Advancement to any particular level of competition.
Athletic development and opportunities depend on numerous factors outside Virtus Athlete’s control.
Participant Responsibility
Parents and athletes remain responsible for decisions made based on information discussed through the Program.
Participation in any workout, training recommendation, nutritional practice, recovery strategy, or other physical activity should be evaluated based on the individual athlete’s circumstances and, where appropriate, discussed with qualified professionals.
7. Mentor Relationships and Communications
Virtus Athlete is designed to create appropriate mentor-athlete relationships in a structured environment.
Athletes and parents agree to use communication and scheduling methods authorized by Virtus.
Members may not use the Program to solicit mentors for private services outside Virtus Athlete, circumvent Virtus, or establish unauthorized commercial relationships with mentors introduced through the Program.
Virtus may establish or modify communication guidelines when necessary to protect athletes, mentors, families, and the Program.
8. Code of Conduct
Virtus Athlete is intended to provide a respectful, constructive, and safe mentorship environment.
Parents and athletes agree not to:
Harass, threaten, intimidate, discriminate against, or behave abusively toward mentors, staff, guest speakers, or other participants;
Engage in inappropriate, sexually explicit, threatening, or unlawful communications;
Record, screenshot, copy, distribute, publish, or republish Program sessions or materials without authorization;
Share Program recordings with individuals who are not authorized to access them;
Share login credentials, private scheduling links, or other restricted access information outside the household;
Attempt to circumvent Program fees or membership requirements;
Contact mentors through unauthorized channels for the purpose of obtaining services outside Virtus;
Disrupt group sessions or interfere with another athlete’s participation;
Misrepresent themselves or another participant; or
Use Virtus Athlete for any unlawful purpose.
Virtus reserves the right to remove an athlete or parent from a session or terminate participation when conduct violates these standards or creates a safety or welfare concern.
9. Sessions and Recordings
One-on-One Sessions
Virtus Athlete’s individual one-on-one mentorship sessions are not routinely recorded by Virtus.
Participants may not independently record a one-on-one session without the express permission of Virtus and all individuals participating in the session.
Group Sessions
Virtus Athlete group sessions may be recorded so members who cannot attend live can access a replay and so Virtus can provide Program content to its membership.
An athlete participating in a group session may appear in a recording by name, image, likeness, and/or voice.
Parents or guardians will be asked to provide applicable consent regarding their athlete’s participation in recorded sessions.
Group session recordings may generally be retained for up to 60 days, after which Virtus may delete them unless a longer retention period is reasonably necessary for legal, safety, administrative, or other legitimate purposes.
Access to recordings is intended only for authorized Virtus Athlete members. Members may not download, redistribute, publicly post, sell, or otherwise share recordings without written permission from Virtus.
Marketing and Promotional Use
Participation in the Program does not automatically grant Virtus unrestricted permission to use a minor athlete’s name, image, voice, likeness, testimonial, or recorded participation for public advertising or promotional purposes.
When Virtus wishes to use such content for marketing or promotional purposes, appropriate parent or legal guardian consent will be obtained separately.
10. Intellectual Property
Unless otherwise stated, Virtus Athlete owns or has permission to use the content made available through the Program, including its curriculum, development framework, educational materials, session materials, videos, newsletters, graphics, logos, website content, and other proprietary materials.
Members receive a limited, personal, revocable, non-exclusive, and non-transferable right to access Program materials for their athlete’s personal participation in Virtus Athlete.
You may not, without written authorization from Virtus:
Sell or commercially exploit Program materials;
Redistribute Program materials;
Publicly post private Program content;
Copy substantial portions of the curriculum or materials;
Create competing or derivative materials substantially based upon proprietary Virtus content; or
Remove Virtus branding or ownership notices from Program materials.
11. Third-Party Services
Virtus Athlete relies on third-party technology and service providers, which may include:
Squarespace for website services;
Square for payment processing;
Zoom for virtual sessions; and
Google services for certain files, recordings, communications, or administrative functions.
Your use of third-party platforms may also be governed by their respective terms of service and privacy policies.
Virtus does not control and cannot guarantee the continuous availability, security, performance, or operation of third-party services.
12. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Program is provided on an “as is” and “as available” basis.
Virtus makes no warranties, express or implied, regarding the Program, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, or non-infringement, except where such warranties cannot legally be excluded.
We do not guarantee uninterrupted access to the website, virtual sessions, scheduling systems, recordings, mentors, or other Program features.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Virtus Athlete and its owners, founders, mentors, employees, contractors, representatives, guest speakers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to participation in or use of the Program.
To the fullest extent permitted by law, Virtus Athlete’s aggregate liability arising from or relating to the Program will not exceed the amount actually paid by you to Virtus Athlete during the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
14. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Virtus Athlete and its owners, founders, mentors, employees, contractors, representatives, and partners from claims, liabilities, damages, losses, and reasonable expenses arising from your or your athlete’s violation of these Terms, misuse of the Program, or unlawful conduct.
15. Suspension and Termination
Virtus may suspend or terminate participation in the Program if:
You or your athlete violate these Terms;
Required payments are not made;
A participant engages in inappropriate or unsafe conduct;
Program access is abused or shared without authorization; or
Virtus reasonably determines suspension or termination is necessary to protect an athlete, mentor, participant, or the integrity of the Program.
If Virtus terminates a membership without cause, Virtus may provide an appropriate prorated refund for any prepaid, unused period notwithstanding the general no-refund policy.
Termination for violation of these Terms does not entitle the member to a refund.
16. Changes to These Terms
Virtus may update these Terms periodically.
When we do, we will update the “Last Updated” date displayed above. If changes materially affect members’ rights or obligations, we will provide reasonable notice.
Continued use of the Program after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by applicable law.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles.
To the extent permitted by applicable law, any dispute, claim, or legal proceeding arising from or relating to these Terms or the Virtus Athlete Program will be brought exclusively in the appropriate state or federal courts located in Erie County, New York, and you consent to the jurisdiction and venue of those courts.
18. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect to the fullest extent permitted by law.
19. Entire Agreement
These Terms, together with the Virtus Athlete Privacy Policy and any additional consent forms or policies presented during registration, constitute the agreement governing participation in the Program.
If a separate promotion, membership commitment, or written agreement contains additional terms, those additional terms will also apply to that specific offer or arrangement.
